    摘要:

    为探索职业院校混合所有制改革政策的实施情况,进一步完善制度体系。以职教混改的制度文本为分析基础,以相关司法案例为实证对照,发现现行制度存在位阶较低、过于笼统、定义宽泛、管理模糊等问题,上述问题也在司法案例中得到印证。通过合理界定混合所有制办学的概念、明确不同模式办学的产权制度、管理机制、支持措施和法律责任、健全监管机制、提高立法质效等,有助于提升办学主体积极性和办学成功率。

    Abstract:

    In order to explore the implementation of the mixed ownership reform policy of vocational colleges and further improve the institutional system, this paper takes the text of the policy as the research basis and takes relevant judicial cases as an empirical comparison. It is found that the current system has problems such as low rank of policy, extensive provisions, broad definition, and vague regulations on management, and the above problems have also been confirmed in judicial cases. By rationally defining the concept of mixed ownership schooling, clarifying the property rights system, management mechanism, support measures and legal responsibilities of different modes of schooling, improving the supervision mechanism, and the quality and efficiency of legislation, it will help to enhance the enthusiasm of school-running entities and the effectiveness of school-running.
